The Financial Services and Markets Act 2022 (“FSMA”) was passed on 5 April 2022, to function as an omnibus Act for the sector-wide regulation of financial services and markets. It consolidates certain provisions previously contained in the Monetary Authority of Singapore Act 1970, such as general inspection powers of the Monetary Authority of Singapore (MAS).
It also introduces new provisions such as harmonised and expanded regulatory powers to issue prohibition orders, as well as a new licensing regime for the regulation of certain “digital token service providers”.
The FSMA has been implemented in phases, the first substantive phase starting from 28 April 2023. On 30 May 2025, MAS responded to feedback on a consultation paper on the proposed regulatory approach for “digital token service providers” under Part 9 of the FSMA, and announced that the licensing regime under Part 9 (as well as other miscellaneous provisions and subsidiary legislation) would commence on 30 June 2025.
This seminar will first provide further context on the FSMA as a whole and its various component Parts, with a particular focus on the upcoming commencement of Part 9 of the FSMA on 30 June 2025.
